Does that name ring a bell or have any importance to you?

Well, this Sunday you'll be celebrating Father's Day thanks to Dodd who originated this special day for fathers everywhere. Better yet, this Sunday marks the 100th birthday of Father's Day! That's right, Father's Day has been celebrated for 100 years. Now sit back, relax and let me retell the story of how Father's Day came about...White Rose

Once upon a time in Spokane, Washington,
a young woman was sitting in church, attentively listening to the Sunday sermon on Mother's Day. It was the year 1910, two years after the first Mother's Day observance in West Virginia.

During this sermon, Mrs. Sonora Smart Dodd realized something as she listened about the maternal sacrifices made for children -- it was her own father that made the sacrifices as he raised her and her 5 brothers...ALONE...after his wife died during childbirth. She realized fathers must also be recognized for their sacrifices and hard work, too.

And thus the idea of having a Father's Day was born and proposed. While the town of Spokane strongly supported it, it did receive a bit of criticism before it officially became an official observance in 1972, 62 years after it was proposed.

During the first observance, young members of the YMCA went to church wearing roses: a red rose to honor a living father, and a white rose to honor a deceased one. Dodd traveled through the city in a horse-drawn carriage, carrying gifts to fathers.

Dodd wanted Father's Day to be observed on her father's birthday (June 5), but the ministers claimed they needed extra time to prepare sermons on the new subject of fathers. This is why Father's Day always falls on the third Sunday of June.

Residential Real Estate Contract - Tip # 4

Originally posted on Mama Liz Blog I continue to be horrified with poorly written contracts -- Please when you are writing an offer to purchase a property, you want it to be enforceable.

You need to take extra caution to be sure that all your t's are crossed and your i's dotted.

1) Do not replace just one page of a contract, because that is the only page with a change. If there is ever a reason to go to court over the contract, you need for all the pages to look the same. If there needs to be a change on one page, the entire contract should go back and forth - getting the proper initials and dates. This was covered in Residential Real Estate Contract - Tip # 3 . Just because the "other agent"or the "other party" says to do it one way does not mean that the contract will be enforceable. Learn the correct way.

2) As stated in Residential Real Estate Contract - tip # 2, be careful with your financing clause.

3) As stated in Residential real Estate Contract - Tip # 1, one needs to be careful with your closing date.

4) So, Tip # 4 = Every blank on the contract should have something in the blank. If there is nothing to go in the blank, then you should put "n/a". Contract Tips are brought to you by:

Mt Pleasant SC -- Alligators

Alligators are in the pond between Laurel Lakes and the Loadholt property. This morning while Boyd was doing his early morning walk, one was sunning on the Loadholt property side of the lake animation - alligatorjust behind the barn on the edge of the pond. So, those of you who go swimming in that pond had better think twice about doing that -- I hear folks saying "Nah, there are no alligators there" -- Well, Boyd saw one with his own eyes this morning. The one he saw was about 3 feet long -- so there are probably others in there. Eliza, our granddaughter, made a sign and we helped her post it on a tree to warn folks about the alligators.

Bridal Shop in Mt Pleasant, SC --  Jean's of Mt Pleasant, SC is a bridal shop that provides all your bridal needs - wedding gowns, bridesmaids, flower girls, mother of the bride, mother of the groom, groom, groomsmen, ring bearer and accessories.


Jean Wellmon opened her shop in 1974 in Mt Pleasant.  When Jean first opened her store, it was located on Coleman Blvd. in Mt. Pleasant.  Jean at that time did mostly seamstress work ---when my daughter was in elementary school, she was sooooo tiny that I could not purchase clothes that fit her --in comes Jean Wellmon who made all my daughter's clothes for school.  Obviously, our family got to know she and her family over the years. Jean has always been a perfectionist.  Her clothes were incredible. At some point, she moved her business to Fairmont and started carrying bridal clothes.

In 1984 Jean & her husband, Chuck bought the current building       Jean's of Mt PleasantLafayette Village sign

in Lafayette Village and moved their location. At that time Jean's was a combination of a women's dress shop and a bridal shop in Charleston. I have bought many pieces of clothing from her over the years. What was so neat was that if something didn't fit quite the way you wanted, well, no problem -- enters the seamstress and she makes it perfect. Her line of clothing was top quality -- one was proud to say, " I got this dress at Jean's" whether it was a bride's dress or a dress for a dress up occasion or just a dress for casual wear.

SC has become a complete Bridal Shop in Charleston, SC where the bride to be can find any and everything she wants. She does not have to worry about quality --

Jean's daughter, Michelle Wellmon Cost, started working in the shop with her mother when she was a child --hanging out and of course helping as much as she could.  In 1991 Michelle became full time and became the Manager of the Bridal Shop in Charleston called Jean's of Mt. Pleasant -Jean would not put Michelle in a day care - she was always at the store. Guess you would say, she definitely has Jean's of Mt. Pleasant in her blood and in her psychic.

Battle of the AVMs: An Online Real Estate War

Last year November, the Realtor® Property Resource (RPR) announcement by the National Association of Realtors® (NAR) shook the industry. NAR had just reached an agreement with Lender Processing Services (LPS) and announced their plans on launching the Realtor® Valuation Model (RVM) in hopes that it will become the “gold standard” used by financial in the majority of online valuations.

For a detailed account on Automatic Valuations Models (AVM) and the events that led up to the creation, the structuring, the benefits and the concerns of RPR read the latest edition of the Swanepoel TRENDS Report. In the Report we also discussed some of the leading contenders; Zillow, Google and First American. Zillow is of course widely known for its popular “Zestimates” and has been using an online automated valuation services since going live in 2006. It the lesser known of the bunch, Corelogic, that is now drawing attention.

Inside Story

First American is in the process of splitting its Information Solutions Group (CoreLogic) and Financial Services Group into two separate, publicly traded companies. The separation is targeted to close next week on June 1, 2010 and CoreLogic is set to trade under the symbol CLGX. Just as Corelogic is being spun off from First American Corporation (NYSE:FAF) so LPS was spun off last November from Fidelity National Financial (NYSE: FNF).

So what does that all mean?

Well, last week CoreLogic filed a lawsuit against eight companies, including Zillow and LPS claiming the companies’ automated valuation models infringe on their 1994 patent. CoreLogic is seeking an injunction against these companies to prohibit them from using or selling those types of services, both that they claim any products that according to CoreLogic fall within the scope of their patent. Other companies also named in the lawsuit include: Fiserv Inc., Intellireal LLC, Interthinx Inc., Precision Appraisal Services Inc., Real Data Inc. and RealEC Technologies Inc.

FYI, it appears that the first patent for an “automated real estate appraisal system” was granted on Nov. 1, 1994 (U.S. Patent 5,361,201) and was issued to the inventors Allen Jost, Jennifer Nelson, Krishna Gopinathan and Craig Smith. Subsequently those rights were assigned to Transamerica Intellitech Inc., then First American Residential Services and now reside with CoreLogic.

The patent application describes the algorithms and dozens of variables that could be used to generate valuations, and how predictive models could generate estimated property values based on individual property characteristics and neighborhood or area characteristics. Through a trial and error process the model “learns” and thereby improving the results.

So What’s Next?

Patent lawsuits are traditionally very difficult to prove and can take many years to resolve. Parties have to demonstrate that a patent is or isn’t unique, already in use, overly broad or vague. In this case I am sure there will be a huge debate.

As this whole debate develops, don’t think Zillow will stop offering zestimates or that NAR will back off RPR and their dream of creating the “gold standard.” No, for now it’s business as normal. First a lot of water has to flow under the bridge before either side will anyone will know whether this lawsuit will have a chance of succeeding or not. If it turns out that First American will prevail, a licensing agreement or changes to existing AVM models will most likely occur very quickly.

This recent legal action between major corporations is however worth noting because it underscores the growing online turf war surrounding real estate data. Remember in the most recent edition of the Swanepoel TRENDS Report real estate data was listed as the #1 trend for broker, agents and professionals to watch closely.

Whether it’s AVM’s, the MLS, IDX, RETS standards, RPR or any one of the many other technology initiatives or acronyms, it’s very clear that the battle lines have been drawn.

Why the fuss? Well the winner(s) will most likely dominate the very attractive and lucrative real estate data market for the next few decades.
